DUI – WHAT IS IT?
“DUI” or “driving under the influence” means that the driver was substantially incapable of safely operating a motor vehicle. DUI is a misdemeanor offense which carries significant criminal and administrative penalties. You will face significant jail time, up to $1000 in fines, extravagant court costs, up to 96 hours of useful public service, alcohol education classes and therapy, and 12 points against your driving record. These penalties increase if the driver has a prior DUI related arrest and is facing a second, third, fourth or subsequent DUI charge.
Additionally, the driver will face significant administrative penalties at the Colorado Department of Motor Vehicles. The administrative penalties are separate and distinct from the criminal penalties.
DWAI – WHAT IS IT?
DWAI or “driving while ability impaired” means that the driver was impaired by drugs or alcohol to the slightest degree. DWAI is a misdemeanor offense which carries up to 180 days in jail, up to $500 in fines, court costs, up to 48 hours of useful public service, alcohol education classes and therapy, and 8 points against your driver’s record.
Additionally, the driver may face administrative penalties at the Colorado Department of Motor Vehicles.
