DUI – DWAI REPEAT OFFENSES PENALTIES
In Colorado, penalties for a DUI 2nd Offense and DUI 3rd Offense can routinely include:
Up to one year in jail;
Up to two years or more of probation;
Extended loss of your driver’s license;
Fines and costs in excess of $1500;
Lengthy hours of Useful Public Service;
Extensive Alcohol classes and therapy;
A MADD Panel;
Monitored Sobriety; and
Other conditions as well.
DUI JAIL REALTIES
A DUI-DWAI first offense in many instances is not likely to result in any actual jail time. The jail for a first offense can be suspended or waived if you submit to and complete an alcohol education course and any court-ordered therapy.
A DUI-DWAI second offense however is very likely to result in actual jail time. Jail is mandatory if the second offense occurred within 5 years of the date of the first offense. A jail sentence from 10 days up to 90 days is common for a second drunk driving related offense. WHERE POSSIBLE I will seek an in-home detention sentence or a community justice sentence.
A DUI-DWAI third offense is very likely to result in actual jail time. Jail is mandatory for a DUI third offense. A jail sentence of six months to a year is common for a third drunk driving related offense. An IHD sentence is not realistic for a third alcohol related offense.
ADDITIONAL PROBATION – In addition to serving a lengthy jail sentence, a repeat DUI-DWAI offender will have to also attend and complete a lengthy period of probation.
