Colorado DUI Drug Laws
DUI or “Driving Under the Influence” covers not only alcohol offense but drug use and possession as well. Although the use of marijuana is legal in Colorado, driving a vehicle while using marijuana will result in a DUI charge.
If you are arrested for DUI -drugs, the Police can demand that you submit to a blood draw.
Colorado law states that as little as five nanograms of THC in the blood stream meets the threshold for driving under the influence of marijuana.
If you are stopped for a simple traffic offense, the police can arrest you if they observe signs of impairment or any other signs that a driver has used marijuana.
The police can charge you with a DUI for any level of a prohibited drug in your system. This includes prescription drugs.

DRUG RECOGNITION EVALUATION (DRE)
When a driver is suspected of “driving high” or driving under the influence of drugs, specifically trained police officers are called upon to perform a Drug Recognition Evaluation on the driver.
Drug use and Alcohol use create different indicia of impairment.
A DRE is field sobriety test designed to detect drug use. This type of evaluation is voluntary. You need not comply with the request to submit. If you agree to the evaluation, the police officer will testify in court as to the observations and findings. If you are asked to submit to a blood test, my advice is to comply. A blood test to detect drugs may show whether there were any traces of drugs in your system.
A blood test can be challenged upon the grounds that the result does not necessarily mean the driver was impaired. An experienced defense attorney can challenge the State’s evidence in court. I have the experience to make this challenge.
