What are the Potential Penalties for Domestic Assault?

There are times when family members in Colorado become upset with each other. It is common for arguments to start. Sometimes for minor disagreements and sometimes for major fights. People may say very hurtful things to each other and it can cause major problems for the family. However, sometimes these fights become physical or there may be threats made that people will physically harm other family members.

It is important that the fights do not become physical. If they do, it is considered an assault like if people harm people outside their home. However, since it occurs between family members, it is considered a domestic assault has a different set of rules. People convicted of domestic assault will face some different penalties than people convicted of an assault of a person outside of their family.

Potential Penalties for Domestic Assault

If people are convicted of domestic assault they could face jail time and fines like other people charged with assaults, but there are additional penalties that are unique to domestic assaults. One is that people will need to complete a domestic assault treatment program. They will also be prohibited from possessing guns and ammunition if they are convicted or while there is a protective order in place. House arrest that may be an option in other cases will not be an option, if the home is where the victim lives at. The penalties will also increase if people have been previously convicted of a crime.

Being charged with a domestic assault is a serious charge in Colorado. The penalties can be severe and affect people in more ways than just jail time or a fine. It affects many aspects of their lives for a lengthy period of time. Being charged with domestic assault does not automatically mean that people will be convicted of the crime though. Everyone is innocent until proven guilty and there may be defenses available. Experienced attorneys understand the potential defenses and may be a useful resource.
